These Terms and Conditions apply to any order placed by a visitor to this e-commerce website Onpex. If delivery, reservation or administrative fees are charged, this will be stated separately. The delivery costs depend on the weight of your order and on the dimensions of the items ordered. Should these be increased for any reason, the customer will be notified by e-mail and must confirm by e-mail before shipping the package. The statement of price refers only to the items as it is described verbatim. The accompanying photographs are for decorative purposes and may contain elements not included in the price. Article 3: Offer Despite the fact that the online catalog and e-commerce website are compiled with the utmost care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Onpex. Onpex is only bound by an obligation of means with regard to the accuracy and completeness of the information offered. Onpex shall in no case be liable in case of manifest material errors, typesetting or printing errors. The offer is always valid while supplies last and may be modified or withdrawn by Onpex at any time. Onpex cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is subject to conditions, this will be explicitly mentioned in the offer. Article 4: Online Purchases When you click on the article you want on our website www.onpex.be you will see the product description and you can fill in the desired number of pieces, then click on 'add to cart' and this product will automatically end up in your shopping cart, the shopping cart can be found at the top right of every page. You can simply continue shopping or use the shopping cart to place your order. When you have finished shopping, go to your shopping cart to place your order, otherwise your order will not be placed. When you get to your shopping cart you will see an overview of your desired products and quantities. You can also calculate the shipping costs, change your order or adjust the quantities. If you agree and everything is correct, click on checkout. You then have the choice to create an account or not if this is the first time you make a purchase on our website, if you have purchased from us before and created an account you can simply log in. Article 5: Delivery and execution of the agreement The delivery of packages is done as quickly as possible in order to serve the customer as soon as possible, as soon as we receive the payment your package leaves as soon as possible, if the product is in stock it is delivered immediately and a confirmation email follows with the details for those who paid by bank transfer. If it is not a warranty case, the return costs and shipping costs for the new article are to be borne by the customer. If you are not at home or the package is not picked up , then this automatically comes back to us then shipping and management fees will be charged again to send your package for the second time. If you provide us with an incorrect delivery address and the package is returned to us, the second shipping cost will be at the customer's expense anyway, so please check that you did enter the correct information before placing the order. Delivery is made by DPD orHeppner. Shipping cost depends on weight and dimensions. Unless otherwise agreed or expressly stipulated, goods will be delivered to the Customer's place of residence within 30 days of receipt of the order. If a longer delivery period occurs, Onpex will notify the Customer. We strive to deliver as soon as possible. Any visible damage and/or qualitative deficiency of an item or other failure in delivery must be reported by the Customer to Onpex without delay. The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) takes physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier was instructed by the Customer to transport the goods and this choice was not offered by the Onpex company. Article 6: Retention of title The delivered articles remain the exclusive property of Onpex until the moment of full payment by the Customer. The Customer undertakes to draw the attention of third parties to Onpex's retention of title if necessary, e.g. to anyone who would come to seize items that have not yet been paid for in full. Article 7: Right of withdrawal The provisions of this article apply only to Customers who purchase items online from Onpex in their capacity as consumers. The Customer has the right to revoke the agreement within a period of 14 calendar days without giving reasons. The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good. The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so. If the Customer uses this option, we will send the Customer an acknowledgement of receipt of his withdrawal on a durable medium (e.g. by e-mail) without delay." To comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired. The Customer must return or hand over the goods to Onpex, Evarist Carpentierlaan 43, 8500 Kortrijk, without delay, but in any event no later than 14 calendar days after the day on which he communicated his decision to withdraw from the contract to Onpex. The Customer is in time if he returns the goods before the period of 14 calendar days has expired. The direct costs of returning the goods shall be borne by the Customer. If the customer so desires, we can come and collect the goods back from the customer, the costs of which will be equal to the delivery cost, for which the products must always be in the same condition as when they were delivered to the customer, otherwise there will be an increase in the transport costs to the disadvantage of the customer. The Customer must first reimburse Onpex for the return transport costs before Onpex orders the transport company to collect the goods. If the returned product is in any way diminished in value, Onpex reserves the right to hold the Customer liable and claim damages for any diminution in the value of the goods resulting from the Customer's use of the goods beyond what is necessary to establish the nature, characteristics and operation of the goods. Only items in their original packaging, along with all accessories, instructions for use and invoice or proof of purchase can be taken back. If the Customer has requested that the performance of services begin during the withdrawal period, the Customer shall pay an amount proportional to what has already been delivered at the time he has notified us that he is withdrawing from the contract, compared to the full performance of the contract." If the Customer withdraws from the agreement, Onpex shall refund all payments received from the Customer up to that point, including standard delivery charges, to the Customer within a maximum of 14 calendar days after Onpex has been notified of the Customer's decision to withdraw from the agreement. For sales contracts, Onpex may wait to refund until it has received all the goods back, or until the Customer has proved that he has returned the goods, whichever time comes first with the exception if Onpex comes to collect the goods. Any additional costs resulting from the Customer's choice of a mode of delivery other than the cheapest standard delivery offered by Onpex will not be refunded. Onpex will refund the Customer using the same means of payment with which the Customer made the original transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not be charged for such refunds. The Customer cannot exercise the right of withdrawal for:
Service agreements after the full performance of the service.
The supply or provision of goods or services whose price is subject to fluctuations in the financial market over which Onpex has no control and which may occur within the withdrawal period;
The delivery of goods manufactured to the Customer's specifications, or clearly intended for a specific person.
The delivery of goods that spoil quickly or have a limited shelf life;
The delivery of sealed goods that are not suitable to be returned for reasons of health protection or hygiene and whose seal has been broken after delivery.
The supply of goods which, after delivery, are by their nature irrevocably mixed with other products.
Agreements where the Customer has specifically requested Onpex to visit him to make urgent repairs or maintenance there.
The delivery of sealed audio and sealed video recordings and sealed computer software whose seal has been broken after delivery.
Contracts concluded at a public auction.
The provision of accommodation other than for residential purposes, transportation of goods, car rental services, catering and services related to leisure activities, if the contracts provide for a specific date or period of performance.
The supply of digital content not delivered on a tangible medium, if performance has begun with the Customer's express prior consent and provided the Customer has acknowledged that he thereby forfeits his right of withdrawal (e.g. music downloads, software)
Article 8: Warranty Under the Act of September 21, 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights. To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods. For items purchased online and delivered to the Customer's home, the Customer must contact Onpex Customer Service and return the item to Onpex at the Customer's expense. If a defect is detected, the Customer must inform Onpex as soon as possible. In any case, any defect must be reported by the Client within a period of 1 month after its detection. Thereafter, any right to repair or replacement expires. The warranty (commercial and/or legal) is never applicable to defects that arise as a result of accidents, neglect, falls, use of the item contrary to purpose for which it was designed, non-compliance with user instructions or manual, modifications or alterations to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use. Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, subject to proof to the contrary by the Customer. Any complaints can be directed to this address. Article 10: Penalties for non-payment. Without prejudice to the exercise of other rights available to Onpex, in the event of non-payment or late payment, the Client shall be liable, ipso jure and without formal notice, to pay interest of 10% per year on the unpaid amount from the date of default. In addition, the Client shall be liable, ipso jure and without notice, to pay a fixed compensation of 10% on the amount in question, with a minimum of 25 euros per invoice. If necessary, you can also ask to correct the data that are incorrect, incomplete or irrelevant. In case of use of data for direct marketing: You can oppose the use of your data for direct marketing free of charge. We treat your data as confidential information and will not transfer, rent or sell it to third parties. However, personal information may be passed on to companies that work with us to process your order such as transportation companies. The failure at any time by onpex to enforce any of the rights enumerated in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of such rights. Article 14: Modification of conditions These Conditions are supplemented by other conditions explicitly referred to, and the general conditions of sale of onpex. In case of contradiction, these Conditions shall prevail.
Article 15: Proof
The Customer accepts that electronic communications and backups may serve as evidence.
Article 16: Applicable law - disputes
Belgian law is applicable, with the exception of the provisions of international private law on applicable law.
The courts of Kortrijk have jurisdiction in the event of legal disputes.
